Can I use my SMSF to purchase an investment property?
Yes — provided your fund’s trust deed permits it and the purchase meets the sole purpose test under superannuation law. The property must be bought for investment purposes only and cannot be lived in or used personally by you or any related party. We strongly recommend working with an SMSF-specialist accountant or financial adviser before proceeding.
Our role is to find and secure the right property at the right price. We conduct the search, due diligence, and negotiations on behalf of your fund — the same process as any investor client, but with an understanding of the compliance context your purchase must sit within.
Yes. Residential property purchased through an SMSF cannot be acquired from a related party and cannot be rented to a related party. Commercial property has different rules and can in some cases be leased to a related business. Your financial adviser or SMSF specialist should confirm what is permissible for your fund’s specific structure.
If your fund is using a Limited Recourse Borrowing Arrangement (LRBA) to fund the purchase, there are additional restrictions on the type of asset and any improvements that can be made post-settlement.
